1. Agreement and eligibility
These terms form an agreement between you and Loytap, a platform operated by Hilvy.io, when you access the website, create an account, subscribe to the service or use a Loytap loyalty card. “You” may mean a subscribing café, an authorised team member or a loyalty customer, depending on the context.
By using Loytap, you agree to these terms and our privacy policy. If you use Loytap for a café or other organisation, you confirm that you have authority to accept these terms for that organisation.
Café subscriptions are intended for business use. If you use any part of Loytap as a consumer, your mandatory consumer rights are not affected and these terms do not limit rights that cannot legally be limited.
2. The Loytap service
Loytap provides digital loyalty tools that may allow a café to create a branded loyalty card, scan a customer’s QR code, add stamps, manage rewards, view loyalty activity, organise members into useful groups and send messages.
The café decides its own reward, qualification rules, availability and any reasonable expiry terms. Loytap supplies the software; it does not supply, fund or redeem the café’s reward. Features may vary by plan, device or location and may change as the service develops.
The café directory is provided to help people discover cafés. Listing information may come from owners and public sources. We aim to keep it useful and accurate but do not guarantee that every listing, opening time or business detail is complete or current.
3. Café responsibilities
A subscribing café is responsible for:
- providing accurate business, account and billing information;
- setting clear loyalty and reward rules and honouring rewards presented as available;
- making sure team members add stamps and rewards accurately;
- providing customers with appropriate privacy information;
- having a lawful basis for customer data and electronic messages;
- respecting message preferences, objections and unsubscribe requests;
- reviewing message recipients and content before sending; and
- complying with consumer, marketing, equality and data protection law.
Automated groups and insights are practical software tools, not guarantees or professional advice. The café remains responsible for decisions based on them.
4. Accounts and security
You must provide accurate information, keep login details confidential and use reasonable security measures. A café is responsible for activity carried out by its authorised team members and should remove access promptly when a person no longer needs it.
Tell us at info@loytap.com as soon as possible if you believe an account or loyalty card has been accessed without permission. You must not share an individual loyalty card in order to collect stamps or rewards dishonestly.
5. Subscriptions, payment and cancellation
Subscription fees, billing periods and included features are shown when you order or recorded in a separate agreement. Unless stated otherwise, subscriptions are billed in advance on a monthly or annual basis and applicable taxes may be added.
A subscription renews for the same billing period unless it is cancelled before the next renewal date. You may cancel by contacting us; access continues until the end of the paid period. Fees are generally non-refundable once a billing period begins, except where law requires a refund or we agree otherwise.
We may change prices or plan features. For an existing paid subscription, we will give reasonable advance notice of a price change and apply it from a future renewal date.
6. Acceptable use
You must not use Loytap to:
- break the law, infringe another person’s rights or send unlawful, deceptive or unsolicited messages;
- upload malicious code, interfere with security, overload the service or probe for vulnerabilities;
- access another account, café or customer record without permission;
- copy, reverse engineer, resell or commercially exploit the service except where we agree in writing;
- manipulate stamps, rewards, analytics or directory information dishonestly; or
- use the service in a way that could harm Loytap, a café, a customer or another person.
7. Data, privacy and ownership
Each party keeps ownership of the information, branding and materials it brings to the service. A café gives Loytap the limited permission needed to host, process, display and transmit its materials and customer data to provide and support the service.
A café controls the customer data in its loyalty programme. Loytap processes that data on the café’s instructions, subject to applicable data protection law and any separate data processing terms. More detail is available in our privacy policy.
Loytap and its licensors own the service, software, design, documentation and branding. These terms give you a limited, non-exclusive, non-transferable right to use the service during your subscription; they do not transfer ownership. If you send feedback, you allow us to use it without restriction or payment, provided we do not identify you without permission.
8. Availability and changes
We aim to keep Loytap available and reliable, but online services sometimes require maintenance or experience faults outside our control. We do not guarantee uninterrupted or error-free access. We may update, replace or remove features where reasonably necessary to improve the service, maintain security or meet legal requirements.
We may suspend access where reasonably necessary to address a security risk, non-payment, unlawful use or a serious breach of these terms. Where practical, we will explain the reason and give the café an opportunity to fix the issue.
9. Warranties and liability
We provide Loytap with reasonable care and skill. Except for rights and promises that cannot legally be excluded, the service is provided without additional warranties, and insights or forecasts should not be treated as a guarantee of customer behaviour, revenue or business performance.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be excluded.
For business customers, neither party is liable for indirect or consequential loss, loss of profit, revenue, goodwill, anticipated savings or business opportunity. To the fullest extent permitted by law, Loytap’s total liability connected with the service in any 12-month period will not exceed the fees paid or payable by the café for that period.
10. Ending the service, changes and contact
You may stop using the website or loyalty card at any time. A café may cancel its subscription as described above. We may terminate an account for a material breach that is not corrected within a reasonable period, or immediately where continued access would create a serious legal or security risk.
When a café subscription ends, access to paid features stops at the end of the applicable period. The café should request or export any available customer data before access ends. We may retain or delete information in line with the privacy policy, the café’s instructions and legal requirements.
We may update these terms as Loytap changes. We will post the new version here and, for material changes affecting an active subscription, provide reasonable notice. Continued use after the change takes effect means the updated terms apply.
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, subject to any mandatory rights that apply to consumers. Questions can be sent to info@loytap.com or through our contact page.
