1. About These Terms
These Terms of Service ("Terms") govern your use of the Loytap loyalty platform, operated by HILVY LTD (Company number 11529251).
By using Loytap, you agree to these Terms. If you don't agree, please don't use our service.
We may update these Terms from time to time. We'll notify you of significant changes via email or through the platform.
2. Who Can Use Loytap
For Coffee Shop Owners (Business Users)
- You must be 18 or older
- You must have the authority to bind your business to these Terms
- You must provide accurate business information during registration
- Your coffee shop must comply with all applicable local laws and regulations
For Coffee Shop Customers (End Users)
- You must be 13 or older (or the minimum age in your jurisdiction)
- You must provide accurate information when signing up for loyalty programs
- You can only create one account per participating coffee shop
3. How Loytap Works
Our Service
Loytap is a platform that helps independent coffee shops:
- Create and manage simple loyalty programs
- Track customer visits and loyalty points
- Send basic loyalty-related emails
- Access insights on customer engagement
- Provide customers with a white-label mobile experience
Current Features
- Visit tracking
- Points system (based on total visits only)
- Customer data: names, email addresses, birthdays
- Reward setup: Cafes can define how many points/visits are needed for a specific reward (e.g., a free coffee). This is currently the only configurable element.
- Analytics dashboard
⚠️ More reward rules, automation, and advanced features may be added in future updates.
4. Coffee Shop Owner Responsibilities
Service Usage
You agree to:
- Use the platform only for legitimate business purposes
- Keep login credentials secure
- Ensure staff are properly trained
- Comply with all applicable data protection laws (including UK GDPR)
- Accurately explain your loyalty program to customers
Customer Communication
- Only send promotional communications to customers who have opted in
- Honour all points and rewards as described in your setup
- Respond to customer support requests about your program
Prohibited Activities
- Creating fake customer accounts
- Using the platform for spam or unsolicited marketing
- Sharing login credentials with unauthorised parties
- Accessing other cafes' data
- Using the platform to attempt to gain access to, scrape, or disrupt systems or data
Acceptable Use
You must not misuse the platform or attempt to interfere with its normal operation. This includes attempting unauthorised access, scraping, reverse engineering, injecting malicious code, or otherwise undermining the integrity or performance of the service.
5. Customer Rights & Responsibilities
Your Rights
- Earn and redeem points based on the cafe's stated rules
- Access and update your personal data
- Withdraw from loyalty programs at any time
- Request deletion of your personal data
- Receive clear information about how your data is used
Your Responsibilities
- Provide accurate sign-up information
- Use your loyalty account fairly
- Keep login credentials safe
- Respect the individual terms of each cafe's loyalty offer
- Report any issues or suspected abuse
6. Payment & Subscription Terms
Pricing
- Loytap costs £350 per year per cafe (or £35 per month, where available)
- Includes full access, white-label mobile support, hosting, support, and updates
Payment Terms
- Subscriptions are paid in advance
- Subscriptions automatically renew unless cancelled before the renewal date
- Payments are securely processed via our payment provider
Cancellation & Refunds
- You can cancel at any time, but no refunds are offered — including for partial months or unused time in an annual plan
- After cancellation, your data will remain accessible for 30 days for export, after which it will be permanently deleted
7. Data & Privacy
Your privacy is important to us. Our Privacy Policy explains in full:

By using Loytap, you agree to the terms of our Privacy Policy.
Data Ownership
Participating cafes retain ownership of their customer data. HILVY LTD only processes data on behalf of the cafes to operate the platform. We do not use, sell, or access this data for our own marketing purposes.
Third-Party Providers
We rely on trusted third-party tools to operate the platform securely:
- NeonDB (UK-based cloud database hosting)
- Resend (email service provider for sending loyalty communications)
All services used comply with UK GDPR standards.
8. Service Availability & Support
Availability
- We aim for 99.9% uptime but do not guarantee uninterrupted service
- Planned maintenance will be announced in advance whenever possible
- We are not liable for interruptions caused by external events beyond our control

- We aim to respond within 2 business days
- Critical platform-breaking issues receive priority
- Helpful guides and resources are available in your dashboard
9. Limitations & Disclaimers
Service Limitations
- The platform is provided "as is" without warranties of any kind
- We don't guarantee that the platform will meet every specific use case
- Loyalty program terms are set and managed by individual cafes
- We are not responsible for disputes between a cafe and its customers
Suspension of Service
We may suspend or restrict your access if:
- You fail to pay subscription fees
- You seriously breach these Terms
- We detect suspicious, abusive, or unauthorised activity
We will attempt to notify you in advance and resolve issues promptly.
Liability Limits
To the maximum extent allowed by law:
- Our liability is limited to the amount you've paid us in the 12 months prior to a claim
- We are not liable for indirect damages, loss of profits, or business interruptions
10. Changes to Service
- We may release new features, improvements, or make changes to the platform at any time
- If we discontinue the platform entirely, we'll give at least 90 days' notice and allow data export
- We reserve the right to terminate accounts that violate these Terms
11. Legal Stuff
Governing Law
These Terms are governed by the laws of England and Wales.
Disputes
We aim to resolve any dispute informally. Please contact us at info@hilvy.io.
If that doesn't work, any legal proceedings will take place in the courts of England and Wales.
Severability
If any part of these Terms is found to be invalid, the remaining provisions will still apply.
